EN STORE TERMS & CONDITIONS — HEMADECK.COM

§1. General Provisions

  1. The online store hemadeck.com is operated by:
    Stark Creations Maks Starkowski,
    address: Jastrzebsko Stare 28C, 64-300 Nowy Tomyśl, Poland,
    NIP (Tax ID): 7882044657,
    e-mail: info@hemadeck.com,
    hereinafter referred to as the “Seller”.
  2. These Terms and Conditions define the rules of using the online store hemadeck.com, in particular regarding:
  • placing orders,
  • concluding sales contracts,
  • delivery of products,
  • consumer rights,
  • complaints and returns.
  1. The store sells:
  • physical products (e.g., card decks, printed materials, accessories),
  • digital products (e.g., PDF files, downloadable materials).
  1. Sales are conducted within the territory of Poland, the European Union, and selected countries outside the EU, excluding the United States of America.
  2. Distribution in the United States is exclusively handled through the authorized partner:

  3. All prices are listed in EUR and include VAT where applicable.

§2. Definitions

  1. Customer – any natural person, legal entity, or organizational unit making a purchase in the store.
  2. Consumer – a natural person purchasing goods for purposes not directly related to business or professional activity.
  3. Product – a movable item or digital file offered in the store.
  4. Sales Agreement – a contract concluded between the Seller and the Customer via the online store.
  5. Business Day – any day from Monday to Friday, excluding public holidays in Poland.

§3. Orders

2. After clicking the “Buy Now” button, the Customer is redirected directly to the payment operator (PayPal) in order to complete the payment.
3. The price displayed on the product page includes the cost of delivery. The Customer does not select the delivery method during the ordering process.
4. After successful payment, the Customer receives an order confirmation by e-mail.
5. The Sales Agreement is concluded at the moment the payment is successfully completed.
6. The Seller reserves the right to cancel an order if payment is not successfully completed.

§4. Payments

  1. Orders paid by bank transfer will be processed after the payment has been credited to the Seller’s account.
  2. The Seller is not responsible for any delays caused by banks or payment operators.

§5. Delivery

1a. The cost of delivery is included in the product price displayed on the website.

2.Standard delivery time is between 3 and 10 business days, depending on the destination country.
3.Shipping costs are displayed at checkout.
4.Digital products are sent manually via e-mail after payment confirmation.
5. In the event that the Customer fails to collect the shipment without a justified reason, the Seller reserves the right to charge the Customer for the costs of returning the parcel to the Sender. In such a case, the Seller may deduct the cost of the return shipment from any refund due to the Customer.
6. By completing the payment, the Customer confirms that they have read and accepted these Terms & Conditions. The Customer is required to accept the Terms & Conditions before placing an order.

§6. Right of Withdrawal

  1. Consumers have the right to withdraw from a sales contract within 14 days without giving any reason.
  2. To exercise this right, the Customer must send a clear statement by e-mail to: info@hemadeck.com.
  3. The Customer bears the cost of returning the goods.
  4. Refunds are issued within 14 days after the returned product is received.
  5. In the case of digital products, if the Customer consents to immediate delivery before the withdrawal period expires, they lose the right to withdraw from the contract.

§7. Complaints

  1. The Seller is responsible for the conformity of the goods with the contract in accordance with applicable EU and Polish consumer protection laws.

  3. The complaint should include: full name, e-mail address, description of the defect, order number.
  4. The Seller will respond to the complaint within 14 business days of receipt.

§8. Personal Data

  1. The administrator of personal data is Stark Creations Maks Starkowski.
  2. Personal data are processed in compliance with GDPR (Regulation (EU) 2016/679) for the purpose of order fulfillment, invoicing, and communication with Customers.

§9. Final Provisions

  1. Any matters not covered by these Terms shall be governed by the laws of Poland and the European Union.
  2. Any disputes arising from sales agreements between the Seller and the Customer shall be settled by competent courts in accordance with applicable law.
  3. The Seller reserves the right to amend these Terms & Conditions. Changes do not affect orders placed before the date of amendment.

§1. Postanowienia ogólne

    zwany dalej „Sprzedawcą”.
  2. Regulamin określa zasady korzystania ze sklepu internetowego hemadeck.com, w tym:
  • składania zamówień,
  • zawierania umów sprzedaży,
  • dostarczania produktów,
  • uprawnień konsumentów,
  • zasad reklamacji i zwrotów.
  1. Sklep prowadzi sprzedaż produktów:
  • fizycznych (np. zestawy kart, gadżety, materiały drukowane),
  • cyfrowych (np. pliki PDF, materiały elektroniczne).
  1. Sprzedaż prowadzona jest na terytorium Polski, krajów Unii Europejskiej i wybranych państw spoza UE, z wyłączeniem Stanów Zjednoczonych Ameryki.

§2. Definicje

  2. Konsument – Klient będący osobą fizyczną dokonującą zakupu w celach niezwiązanych z działalnością gospodarczą.
  3. Produkt – rzecz ruchoma lub plik cyfrowy oferowany w sklepie.
  4. Umowa sprzedaży – umowa zawierana między Sprzedawcą a Klientem za pośrednictwem sklepu internetowego.
  5. Dzień roboczy – każdy dzień od poniedziałku do piątku, z wyłączeniem dni ustawowo wolnych od pracy w Polsce.

§3. Zamówienia

1. Zamówienia składane są za pośrednictwem przycisku „Kup teraz” dostępnego na stronie produktu w sklepie hemadeck.com.
2. Po kliknięciu przycisku „Kup teraz” Klient zostaje przekierowany bezpośrednio do operatora płatności (PayPal) w celu dokonania płatności.
3. Cena produktu widoczna na stronie zawiera koszt dostawy. Klient nie dokonuje wyboru formy dostawy podczas składania zamówienia.
4. Po dokonaniu płatności Klient otrzymuje potwierdzenie zamówienia na podany adres e-mail.
5. Umowa sprzedaży zostaje zawarta z chwilą skutecznego dokonania płatności.
6. Sprzedawca zastrzega sobie prawo do anulowania zamówienia w przypadku niepowodzenia płatności.

§4. Płatności

  1. Dostępne formy płatności:
  • PayPal,
  • Przelew bankowy (dane do przelewu podawane po złożeniu zamówienia).
  1. W przypadku płatności przelewem realizacja zamówienia następuje po zaksięgowaniu środków na koncie Sprzedawcy.
  2. Sprzedawca nie ponosi odpowiedzialności za opóźnienia wynikające z działania banków lub operatorów płatności.

§5. Dostawa

1.Produkty fizyczne są dostarczane za pośrednictwem:
Poczty Polskiej,
firm kurierskich

1a. Koszt dostawy jest wliczony w cenę produktu podaną na stronie sklepu.

2.Termin realizacji zamówienia wynosi zazwyczaj od 3 do 10 dni roboczych, w zależności od kraju dostawy.
3.Koszty dostawy są podawane każdorazowo przy składaniu zamówienia.
4.W przypadku produktów cyfrowych – dostawa następuje poprzez ręczne wysłanie pliku na adres e-mail Klienta po otrzymaniu płatności.
5. W przypadku nieodebrania przesyłki przez Klienta bez uzasadnionej przyczyny, Sprzedawca ma prawo obciążyć Klienta kosztami zwrotu przesyłki do nadawcy. W takiej sytuacji Sprzedawca może pomniejszyć kwotę ewentualnego zwrotu środków o koszty poniesione w związku ze zwrotem nieodebranej przesyłki.

6. Dokonanie płatności za zamówienie jest równoznaczne z potwierdzeniem zapoznania się z niniejszym Regulaminem oraz jego akceptacją. Klient jest zobowiązany do zaakceptowania Regulaminu przed złożeniem zamówienia.

§6. Odstąpienie od umowy

  1. Klient będący Konsumentem ma prawo odstąpić od umowy w terminie 14 dni od otrzymania towaru, bez podania przyczyny.
  2. Aby skorzystać z prawa odstąpienia, Klient powinien przesłać Sprzedawcy jednoznaczne oświadczenie (np. e-mail na adres: info@hemadeck.com).
  3. Klient ponosi bezpośrednie koszty zwrotu towaru.
  4. Zwrot środków następuje w ciągu 14 dni od otrzymania zwróconego produktu.
  5. W przypadku produktów cyfrowych, jeśli Klient wyraził zgodę na rozpoczęcie świadczenia (wysyłkę pliku) przed upływem terminu odstąpienia, traci prawo do odstąpienia od umowy.

§7. Reklamacje

  1. Sprzedawca odpowiada wobec Konsumenta za zgodność towaru z umową zgodnie z przepisami ustawy o prawach konsumenta.
  2. Reklamacje można składać drogą elektroniczną na adres: info@hemadeck.com.
  3. W reklamacji należy podać: imię i nazwisko, adres e-mail, opis wady, numer zamówienia.
  4. Sprzedawca rozpatrzy reklamację w terminie 14 dni roboczych od jej otrzymania.

  2. Dane osobowe przetwarzane są zgodnie z RODO w celu realizacji zamówień, wystawiania dokumentów księgowych oraz kontaktu z Klientem.

§9. Postanowienia końcowe

W sprawach nieuregulowanych niniejszym Regulaminem zastosowanie mają przepisy prawa polskiego oraz prawa Unii Europejskiej.

Spory wynikłe z umów sprzedaży między Sprzedawcą a Klientem będą rozstrzygane przez właściwy sąd powszechny.

Sprzedawca zastrzega sobie prawo do zmiany Regulaminu. Zmiany nie wpływają na zamówienia złożone przed ich wejściem w życie.
